  • Under RCS Revised Pay Rules, 2008: Basic Pay is defined as the sum total of the Running Pay Band plus Grade Pay.
  • Pre-Revised Scales (Before 1-9-2006): For employees drawing pay under pre-revised scales, the appropriate Dearness Pay (DP) is included along with the Basic Pay for calculation purposes.

3. Classification of Cities & Applicable HRA Rates

Government cities and towns in Rajasthan are classified based on population density to determine the appropriate HRA rates:

4. Admissibility Rules (When HRA is Allowed)

To claim HRA under RSR Volume II, specific conditions and timelines must be fulfilled:

  1. Rented Accommodation:
    • Employees living in rented quarters must submit a declaration/certificate of rent payment.
    • Sub-letting Restriction: If the house is sub-let and the rent received from sub-letting is equal to or higher than the paid rent, HRA will not be admissible.
  2. Self-Owned Accommodation:
    • If an employee resides in a house owned by self, spouse, parents, children, or as a coparcener in a Hindu Undivided Family (HUF) property, normal HRA is admissible upon submitting a property tax or maintenance payment certificate.
    • Housing Board Properties: Houses acquired from the Rajasthan Housing Board on a hire-purchase basis are treated as owned houses.
  3. Spouse Posted at the Same Station:
    • When both husband and wife are government servants posted at the same station and sharing the same rented or owned accommodation, both individuals are entitled to draw separate HRA, subject to furnishing individual certificates.
  4. Application Timeline:
    • Employees must apply to the Head of Office within 1 month of occupying a rented or owned house.
    • If an application is submitted after 1 month, HRA will be allowed strictly from the date of application, not retroactively.

5. Non-Admissibility of HRA (When HRA is Restricted)

HRA entitlement is completely restricted under the following conditions:

  • Government/Official Housing: If a government quarter is allotted, or if an employee occupies accommodation/hostels belonging to the Devasthan Department, UIT, Municipality, or any semi-government/autonomous body.
  • Automatic Cancellation Date: Upon allotment of a government quarter, HRA automatically ceases either on the date of occupation or on the 8th day from the allotment date, whichever is earlier.
  • Shared/Dependent Quarter: Sharing rent-free accommodation with another government servant, or residing in a government quarter allotted to a spouse, parent, son, or daughter.

6. HRA Regulation in Special Circumstances

During Leave

  • Standard Leave: Full HRA can be drawn for a maximum period of 120 days. For leaves exceeding 120 days, HRA is limited to the first 120 days only.
  • Exclusions: HRA is not admissible during Extraordinary Leave (EOL), Study Leave, or Terminal Leave.
  • Medical Extensions: For serious illness (Cancer, TB, Leprosy, or Mental disease) supported by a medical certificate, the limit extends to 240 days.
  • Maternity Leave: Extension limit is set up to 180 days.

Temporary Transfer & Deputation

  • Full HRA at old station rates can be drawn for up to a maximum period of 4 months.

Joining Time & Family Retention

  • HRA is drawn at the rates of the old station during joining time.
  • If an employee leaves their family behind at the old station due to non-availability of quarters or rented housing at the new station, HRA at old station rates can be drawn for up to 6 months after assuming charge.

During Suspension

  • HRA is calculated based on the pay drawn during the suspension period.

  • Headquarter Transfers during Suspension:
    • Public Interest Transfer: Calculated at the new station's rate.
    • Request Transfer: Calculated at the lower rate between the old station and the new station rates.
